디지털 성범죄 특성 분석에 관한 연구 : 카메라 등 이용 촬영죄를 중심으로
최근 불법촬영 및 유포 등 디지털 성범죄는 우리 사회에 심각한 사회 문제로 대두되고 있다. 하지만 디지털 성범죄는 최근 새롭게 생긴 신종 범죄가 아니다. 이미 인터넷 사용이 보편화되고 스마트폰이 보급된 1990년대부터 디지털 성범죄는 빈번하게 발생되고 있었다. 하지만 불법촬영 및 성적 영상물의 유포를 단순히 놀이문화로 생각됨에 따라, 최근까지도 디지털 성범죄는 진화되고 있다. 따라서 디지털 성범죄와 관련된 연구는 주목받고 있으나, 주로 법학적 관점에서 범죄 성립에 대한 한계와 처벌규정 강화 등 입법 개정의 필요성을 주장하는 연구가 많다. 이러한 현상을 파악한 결과, 이 연구는 범죄학적 관점에서 디지털 성범죄의 현황 및 실태를 살펴보고 이에 따른 대응책을 마련하고자 하였다. 다만 디지 털 성범죄의 유형 중에서도 불법촬영 범죄를 중심으로 살펴보았다. 대검찰청 통계자료 및 카메라 등 이용 촬영 범죄의 판례분석 결과 불법촬영 범죄의 피해자는 97.0%가 여성이고, 범죄사실이 발각되지 않는 한 피해자는 무한정으로 확산되고 있었다. 또한 피해 장소가 공공장소에서의 발생빈도가 높아 여성 을 비롯한 국민 누구나 피해자가 될 수 있다는 사실을 확인하였다. 그럼에도 불구하고 지금까지 관련 범죄에 대한 처벌 수위는 매우 낮은 것으로 확인되었다. 이러한 범죄 사실을 통해 불법촬영 범죄에 해당되는 디지털 성범죄는 심각한 젠더폭력이라는 것을 입증할 수 있었다. 그리고 불법촬영 범죄의 가해 및 피해 양상이 10대와 20대의 비율이 높다는 점을 고려하여, 해당 연령층을 대상으로 미디어의 올바른 이용 촉진을 위한 미디어 리터러시 교육과 디지털 성범죄 인식 개선의 필요성을 강조하였다. 또한 최근 개정된 처벌 규정 강화에 대한 실효성을 강조하였고, 공공장소에서의 불법 촬영 범죄를 사전에 예방할 수 있도록 관련 지방자치단체의 관심이 필요함을 주장하였다.
A Study on the Analysis of Digital Sex Crime Characteristics : Focusing on the Crime of Taking Photos Using Cameras
Recently, digital sexual crimes are emerging as a serious social problem in our society. However, digital sex crimes are not a new type of crime. Digital sex crimes have been frequent since the 1990s, when Internet use has already become commonplace and smart phones have become popular. However, as illegal shooting and dissemination of sexual images are considered simply as a play culture, digital sex crimes are evolving until recently. Therefore, research related to digital sexual crime is drawing attention. However, digital sex crime research mainly insists on the necessity of legislative amendment. As a result of grasping these phenomena, this study attempted to examine the reality of digital sex crime from a criminal perspective. Among the types of digital sex crimes, I looked at the crimes of illegal shooting. As a result, 97.0% of the victims of illegal shooting were women. And as long as the crime was not discovered, the victims were spreading indefinitely. In addition, it was confirmed that the victims are high in frequency in public places, so anyone, including women, can become victims. However, so far, the level of punishment for related crimes has been confirmed to be very low. Through these crimes, it was confirmed that the illegal shooting of crime is a serious gender violence. In addition, the percentage of those in their teens and twenties was high in the rate of persecution and damage. Therefore, the need for media literacy education and digital sexual crime awareness improvement was emphasized. It also emphasized the effectiveness of strengthening the recently revised punishment regulations. In addition, it emphasized the need for the interest of related local governments to prevent illegal shooting crime in public places.
